Managing Orphan Works is a new section of the Strategic Content Alliance blog dedicated to the publications and tools the Alliance had produced to explain and offer practical advice on a sometimes very complex issue. Managing Orphan Works includes research, briefing papers, template notices and posters, along with a short explanation of how they can be used within your organisation.
According to HM Treasury/BIS’s document Plan for Growth, published today, the UK government is to consider simplifying payments for copyright materials and freeing up orphan works. The relevant sections are:
In response to the Hargreaves recommendations, due in April 2011, the Government will consider simplifying payments for copyright materials and freeing up orphan works. The Government commits to no further broad reviews of the IP rights regime during the lifetime of this Parliament.
2.225 The review of Intellectual Property and Growth, led by Ian Hargreaves, is examining how the UK’s intellectual property framework can further promote entrepreneurialism, economic growth and social and commercial innovation. The review’s recommendations are expected to include measures to modernise the system of copyright licensing to minimise the transaction costs that inhibit innovation and growth, and a proposal to enable access to orphan works. The Government will consider these proposals carefully and will implement as soon as practicable those which will demonstrably contribute to future growth. A commitment to no further broad reviews gives investors certainty over investment. The Government will also set out a five-year international approach to intellectual property.

In November 2010, the Commons Select Committee for Culture, Media and Sport called for evidence-based responses to the Digital Economy Act, 2010 (DEA). Due in part perhaps to the reaction of the creative industries and cultural heritage sector as well as higher education to the DEA, the Select Committee has been asked in investigate to what extent the DEA is a reasonable and sufficient response to the challenges facing the creative industries and individuals in digital markets.
The Culture, Media and Sport Select Committee have, however, agreed to postpone the deadline for written evidence until Friday 6 May 2011 in light of the ongoing judicial review.

Naomi Korn Consulting, commissioned by the Alliance has produced this short briefing paper on how Creative Commons (CC) licences can be embedded within digital resources created and managed by publically funded organizations. The paper aims to give an overview on the benefits of CC licence usage, some considerations to take into account before applying the licences as well as a ‘how to’ guide for embedding and come useful links. This paper accompanies further information on CC licences produced by the Strategic Content Alliance.
In addition, Naomi Korn Consulting has produced an A3 poster that explains the IPR position for organisations dealing with Orphan Works and how they can prevent more Orphan Works being created.
This poster can be printed and displayed within your organisations’ offices, libraries, reading and meeting rooms to draw attention and help staff and students understand some of the issues surrounding Orphan Works.

Academic research receives a boost this week as the JISC-led Strategic Content Alliance announces the Wellcome Library joins its board.
The Wellcome Library is one of the world’s major resources for the study of medical history and provides access to a growing collection of contemporary biomedical information resources relating to consumer health, popular science, biomedical ethics and the public understanding of science.
Stuart Dempster, project director of the JISC-led Strategic Content Alliance says: “The expertise and knowledge from the Wellcome Library will strengthen our work in bringing publicly funded content online. The IPR issues around the sensitive nature of scientific and medical images which the Wellcome Library manages will boost our ability to provide best practice advice and guidance for UK colleges and universities.”
